Arbitration Boards: Mediation. Arbitration. Reconciliation.
Arbitrators mediate disputes under municipal law as well as criminal cases. Compared to appealing to the courts, mediation by the arbitration board in case of disputes and conflicts has significant advantages for the parties involved:
- They avoid protracted legal proceedings with an uncertain outcome
- They save time and costs while avoiding stres
- They can still look their adversary in the eye afterwards
- They keep third parties who might have to be heard as witnesses out of the proceedings and do not endanger their friendships
For private suits, an attempt at arbitration must be made prior to bringing a suit:
- Libel
- Personal injury
- Damage to property
- Breach of domestic peace
- Intimidation
- Violating the privacy of correspondence
A mediator also gets involved in civil disputes:
- Claims not exceeding EUR 600 in money or monetary value
- In case of neighbourhood disputes, for example in case of overgrowth (branches, roots), falling plant material (leaves), trees on boundary lines and noise
- Infringement of personal honour (not committed on radio, television or in the press)
